This privacy statement explains how orphea-photography.be collects personal data and what rights you have with regard to this data.

Cathy Janssens, residing at Gootje 4, 9860 Balegem, trades under the name of Cathy Janssens, a sole proprietorship with business address Gootje 4, 9860 Balegem and CBE number BE 0754 736 313. Cathy Janssens is hereinafter referred to as “Cathy Janssens”, “Orphea photography”, “we”, or “us”.

Processed personal data

Cathy Janssens processes personal data because you use our services, such as the website, and/or those provided by yourself. When you provide personal data to third parties, Cathy Janssens assumes that these third parties agree. The provision of this personal data is your responsibility.

The following data is collected and processed:

  • First and last name
  • Address data
  • phone number
  • E-mail address
  • Photo(s)

This is done by storage in the customer’s personal digital file. Because people are captured in photos, Cathy Janssens also processes special and/or sensitive personal data as described in the General Data Protection Regulation (for example, your race/ethnicity is visible on a photo). By allowing yourself to be photographed, however, you give permission to use these photos for the purposes described.

Cathy Janssens does not intend to collect data from persons under the age of 16 through its website or service, without the consent of parents or guardian. However, it cannot check the age of website visitors, so parents are advised to be involved in their children’s online activities if they do not wish data about their children to be collected without parental consent. If you are convinced that we have collected personal information about a minor without this permission, you can contact us via the contact details above, after which the information will be deleted.

You are responsible for the correctness of the information provided by you and must inform Cathy Janssens as soon as there are any changes.

Reasons for processing

Cathy Janssens processes your personal data for the following purposes:

  • phone number and e-mail address, to be able to call or e-mail you to perform the service (for example: planning a photo shoot),
  • name and e-mail address, to handle your payment,
  • address details and e-mail address, to deliver goods and services to you,
  • photo, to carry out the assignment and complete the portfolio
  • name and e-mail address, to send you a newsletter to inform you of interesting news, if you have given your explicit permission for this or if there is a good reason for us to assume that you would be interested in this
  • if data is requested to enter a competition or receive a freebie, it will only be used for that purpose unless you give additional consent for use for marketing

You will be given the opportunity to unsubscribe in every marketing email.

Automated decision making

Cathy Janssens does not make decisions based on automated processing, i.e. without human intervention, on matters that can have (significant) consequences for people.

Duration of retention

Your personal data will not be kept longer than is strictly necessary to achieve the purposes for which they are collected, as indicated above. Invoicing data is kept for 7 years because accounting legislation requires this.

Final photos taken during photo shoots are kept indefinitely, as they are part of the portfolio.  Unedited pictures are kept for 6 months after the shoot.

Security

Cathy Janssens has organized itself in such a way that your data is optimally secured. We provide password-protected IT and backups of files on a regular basis (at least monthly). Cathy Janssens thus makes all reasonable efforts to protect the confidentiality of your data.

Sharing personal data with third parties

Cathy Janssens shares your personal data with third parties when this is necessary for the execution of the agreement or to comply with any legal obligation (for example: accountant). We enter into an agreement with companies that process your data in response to an instruction from us (for example: for printing a photo album or photo prints) to ensure that the same level of security and confidentiality is maintained as promised to you in this privacy statement . Pictime remains responsible for these processing operations.

View, modify or delete data

You have the following rights with regard to your personal data.

You can view, correct or delete them. You can submit a request to us to send you the personal data we hold about you in a computer file, or to transfer it to another organization mentioned by you. We must supplement or correct incomplete or incorrect data. You can also withdraw your consent to the data processing or object to the processing of your personal data by Cathy Janssens. For example, you have the right to ask us to delete your data when we no longer have a reason to store and/or process it.

To exercise these rights, all you have to do is contact us via the above contact details. To ensure that the request for inspection has been made by you, you are asked to enclose your proof of identity with this request. We will respond to your request as soon as possible, but within [4 weeks]. Submitting a request is free of charge, unless it is manifestly unfounded or excessive. Then administrative costs may be charged.

Adjustments to this statement

Cathy Janssens reserves the right to make changes to this statement. A new version of this statement that differs materially from an earlier version will be actively brought to your attention.
